Terms and Conditions of Auction
By registering to bid, placing a bid online or bidding in any manner offered, Bidders agree to the terms and conditions (written and/or announced) of this auction. This auction takes place in Arizona, so Arizona law applies.
General. This is a cataloged auction and unless otherwise announced by the auctioneer, the items will be offered in order, by lot number, as listed in the catalog. Buyers are given ample opportunity to preview items and are encouraged to consult with whom ever deemed appropriate to acquire satisfaction with regards to value, condition and authenticity of the items. The Auction House does its best to describe and photograph each lot however, those descriptions are our opinion and we are not experts in all fields, so it is ultimately the buyer's responsibility to inspect the item(s) to their satisfaction. In the event of a dispute of a bid, the validity of a bid, the priority of a bid, or any other issue with respect to bidding -- the auctioneer has final say. The title of a lot passes to the winning bidder upon cleared payment.
Estimates. The estimate range is provided as a guide for prospective bidders and is based on the condition, rarity, quality and provenance of the item(s) being offered. They do not constitute a warranty, representation, guarantee or prediction of a selling price. All estimates may be subject to revision at the Auction House discretion. Estimates do not include the buyer’s premium, any applicable taxes, and any other applicable charges. The Auction House is not liable for any errors or omissions with respect estimates in the auction catalog.
Property Condition. The physical condition of products offered can vary due to age. Dents, dings, scratches and other damage or repairs may be present, and is common, on used and vintage items. Opinions of condition may vary from person to person so items are available for preview well in advance of the auction. Please inspect thoroughly PRIOR to bidding. Read the condition report listed for each item and look at the pictures closely and form your own opinion. Bidder/Buyer assumes responsibility for ascertaining the condition of an item in their opinion.
A “Buyer’s Premium” is added to the final hammer amount to help cover fees incurred by the auction house. The premium is as follows: In house, live bidders = 10%. Western Trading Post Website, App. or an Absentee bid left directly with us or Phone-in bids = 12%. Online Marketplace Platforms = 15% to 18% (varies from platform to platform, check auction details on each platform individually for fees)
State sales tax applies (8.7% in Casa Grande, AZ, and other states where applicable). Sales tax is added to purchases within unless a valid resale certificate is provided prior to bidding.
“Buy it Now” is a versatile option which may be offered at the discretion of Western Trading Post, with the cooperation of Sellers. How this works is if a buyer is willing to pay the high estimate plus applicable fees (which would include a 10% Buyer's premium and applicable shipping and handling) for a particular auction lot, they can buy the item(s) now and not wait till auction day. This option is generally available during the first week the auction is posted on our website and is subject to seller approval (which we generally get at the time of consignment). Please see auction description for details.
Item Withdrawal. The auction house reserves the right to withdraw any lot when sold through the buy it now option, or for any other reason, and neither assumes nor accepts any liability contemplated by a potential buyer for such withdrawal.
Payment and Card on file. Bidders need to have a credit card registered prior to bidding activity. Items must be paid for in full on the day of auction for all in house bidders and a receipt is required prior to removal of any items. Online bidders will be sent an invoice at the close of the auction (auctioneer may elect to charge the buyer's card for purchases before shipping is calculated). By agreeing to the terms and conditions and placing bids, bidders grant Western Trading Post permission to charge their credit card (if applicable) without further question, for charges related to purchases. An invoice paid by card and other electronic forms is subject to an additional 3% convenience fee. Charge backs by the cardholder are strictly prohibited and the buyer shall be held legally responsible for any such activity. Alternative forms of payment (check, money order, wire transfer, etc.) are also accepted (checks upon approval). Invoices over $5,000 (and certain other invoices) shall be paid by certified check or wire transfer. Certain gold and silver lots, or purchases by parties unknown to the Auction House, may also be required to be paid by certified funds.
*Please note, if a credit card is declined for any reason, a $15 service charge may be applied to your balance for each attempt to collect payment. If you pay by check, and it is returned, a $25 service charge will apply.
Shipping: Items bought from afar can generally be shipped by Western Trading Post, or we work with a few different shipping services (see catalog for specific lot details). But please remember, we are shipping the item(s) for you, at your expense, and are not responsible for damage or loss caused by the shipping service. Buyer shall pay the shipping cost of items shipped, plus there is a minimum handling/packaging fee (see catalog listing for advertised cost on each lot). This charge is in addition to the cost of postage. We generally send packages priority mail with insurance, but if you want to make sure it is sent some other way, let us know immediately after the auction. Buyer takes the risk for un-insured packages. Once shipping is calculated, buyer will receive a final invoice and instructions on how to pay shipping. This may include a Quickbooks invoice and/or wiring instructions. If we do not hear from online or absentee bidders within 24 hours, we reserve the right to charge their card (if on file) and ship the item(s) to the address provided without further notice. New buyers paying by credit card or check, and buyers wishing to have items shipped to another address other than the billing address of the card they are using, are subject to having the auction house hold their items for up to 30 days in order to make sure the payment clears.
INTERNATIONAL BUYERS: Please note international shipments will have to be serviced through a specialty shipper to accomodate certain requirements such as duty forms, etc.. There will be a $25 per lot charge for facilitating/delivering items to the specialty shipper.

Items not picked up, or arranged to be shipped, or not paid for, or have other arrangements (such as a longer term hold or storage agreement), which are left after 7 days of the date of auction will be considered abandoned and disposed of at the discretion of the auction house with no compensation owed to the person who abandoned their items.
**Money Back Guarantee: If there is a problem with your item, you have 14 days from the date it was purchased to return it to Western Trading Post for a full refund or future auction credit. Buyer to pay return postage and postage is non-refundable and not covered under this guarantee.
Regarding Firearms: Any person(s) bidding on firearms in our auction are required to be at least 18 years of age for long guns and 21 years of age for hand guns. Western Trading Post llc. is a licensed Federal Firearms Licensed (FFL) dealer. Any Bidders who desire to bid on and purchase any firearms in our auctions cannot have been convicted of a felony, have any restraining orders, or have any reason that they would not pass a NICS FFL background check. Western Trading Post llc. reserves the right to run a NICS FFL Background check on any purchaser of firearms. If the Bidder is a resident of the state of Arizona, they may pick up in person once cleared by the NICS FFL background check. Otherwise, firearms will be shipped to a Federal Firearm Licensed Dealer of your choosing nearest your residence. The Buyer agrees to pay for any and all shipping/handling/fees/etc. necessary for the shipping and transfer of firearms. Antique firearms and black powder replicas which are exempted from NICS FFL background checks can be transferred directly to the purchaser (where not prohibited).
Regarding Bidding: Internet, absentee, phone and other acceptable forms of bidding are offered as a convenience to bidders, but Western Trading Post will not be held responsible for any failures or problems in the execution of such bids. All bids are subject to the terms and conditions herein. The option of online and absentee bidding is made available for bidder’s convenience. Absentee bids may be entered by staff into the bidding system (possibly using a house bidding number) or can be entered by the bidder themselves directly into the online platforms. FYI, bidding on behalf of absentee bidders does not start at their maximum bid (unless otherwise instructed), but at the current asking bid. The system bids on behalf of the bidder, just the same as if the bidder was standing in the room bidding against the other bidders. If during the live auction, another bidder does not outbid what the absentee bidder is willing to pay, then the item will be won by the absentee bidder at what ever price was realized when the bidding terminated.
Bidding Priority/Ties: Our auctions are often held on more than one platform simultaneously. When a lot opens for bidding during the live auction, if identical bids have been placed on more than one platform during the pre-bidding, we give priority to the bid placed on our site or app. Please note, it is rare, but possible for a bidder to win a lot for an amount equal to an absentee bidder’s bid. These so-called “ties” will go to the bidder whose turn it was in the bidding in the live auction format. If this is not clear, please ask for further explanation of how bidding works in a live auction format, and realize bids are not technically accepted until acknowledged by the auctioneer.
As a matter of disclosure, Western Trading Post may have a financial interest in any or all of the lots being presented for auction. This interest is, at the very least, a sales commission based on the final hammer price. But it may also include an ownership interest in some lots. We may also bid on some consignments and/or reserves could also be in place where we bid on behalf of the reserve. If you want to know of our possible financial or bidding interest in any particular lot, or if there is a reserve on a particular lot, please contact us before the auction (these questions will not be addressed during the auction or on that day).

Offered here for your consideration are four old and rare books. Included in the lot are The Book of the American Indian by Hamlin Garland with pictures by Frederic Remington and three biographies of early American explorers written by John S.C. Abbott titled David Crockett, Kit Carson, and Daniel Boone. 
The Garland book is a classic volume of 29 stories about Native Americans and it is beautifully enhanced by Frederick Remington illustrations, some full color and some black and white. The books by John S.C. Abbott are biographies of the title characters from his American Pioneers and Patriot series and appear to have been available as a set as they are identically bound. The books are nicely illustrated but only Eleanor Greatorex, the illustrator of Kit Carson is identified. Very nice rare books with interesting stories and illustrations. Find a place in your library for them and place your bid!
MAKER: John S.C. Abbott and Hamlin Garland.
APPROX AGE: Antique (meaning made prior to the 1930s). 
SIZE: Abbott books are each 5 1/2 inches x 7 3/4 inches. The Hamlin Garland book is 9 inches x 12 1/2 inches. 
CONDITION: These books are old. The Garland book was published in 1923 and the Abbott books in the 19th century. SOLD USING THE BUY IT NOW OPTION!!! Offered here for your consideration are two vintage fancy leather cases. The leather of the smaller case is deeply and intricately carved in a floral pattern with tight dark brown stitching along the edges of the handle and the edges of the top and the bottom. There is a mirror in the top and plenty of room to store some necessities. The exterior of the larger case is decorated in a lightly carved but highly detailed floral carving. Open the top center lid for a mirror and storage for smaller items, then open the top for the larger items. Two very nice cases that could be used for decor or for stylish travel. Bid for them today!

Available here for your consideration are two vintage Navajo Eye Dazzlers rugs. These good looking rugs feature similar diamond patterns throughout done in red, brown, white and either gray or tan. Navajo weavings (blankets and rugs) are thought to be some of the most colorful and best-made textiles produced by North American natives. Brilliant colors and bold overall patterns with serrated diamonds, chevrons and interlocking lines are hallmarks of the “Eye Dazzler” style textiles. Offered here for your consideration are prehistoric woven moccasins, etc. in two frames. These interesting woven moccasins and other prehistoric items bear witness to the skill, patience and ingenuity of the inhabitants from that time. Available for you is a group of seven Tohono O'odhan baskets. This group will get you started on that collection with a variety of types, including two unfinished plaques, a large deep bowl, three sizes of shallow bowls, and a pot with a lid. These baskets are a nice sample of Tohono O'Odaham weavings. The Native American Tohono O'odham or Desert People reside in the Sonoran Desert of Arizona and Mexico. Early Tohono O'odham Indian Baskets were primarily utilitarian and later they became more decorative and creative. Tohono O'odham Indian baskets are handmade using native plants such as Yucca, Beargrass, and Devil's Claw for color and substance. Basket forms include a variety of shapes to include plaques, bowls, and pictorial or figural baskets. Bid on this group now to start your collection of Native American basketry!
